Terms & Conditions – Simu Pay

Welcome to Simu Pay. By using our services (including our website, app, and iPhone financing plans), you agree to these Terms & Conditions. Please read them carefully.

1. Eligibility

  • You must be at least 18 years old to use Simu Pay services.

  • A valid Kenyan ID and active Safaricom M-Pesa number are required.

2. Deposits & Payments

  • A deposit is required before receiving your iPhone.

  • The remaining balance must be paid in daily, weekly, or monthly installments, as agreed at the time of purchase.

  • All payments must be made through M-Pesa PayBill or other approved payment methods.

3. Device Ownership

  • The financed iPhone remains the property of Simu Pay until the balance is fully paid.

  • Once all installments are cleared, full ownership is transferred to you and the Simu Pay software is permanently removed.

4. Software & Security

  • Each financed iPhone comes with Simu Pay security software installed.

  • If payments are not made on time, the phone may be restricted or locked until the balance is updated.

  • The software will be removed once the repayment is complete.

5. Late Payments & Default

  • If you miss a payment, you may be charged a late fee.

  • Continuous non-payment may lead to the phone being locked until arrears are cleared.

  • After extended default, Simu Pay reserves the right to repossess the device or take legal action.

6. Refunds & Cancellations

  • Deposits are non-refundable once the device has been issued.

  • In the event of a cancellation before collection, deposits may be partially refunded at Simu Pay’s discretion.

7. Warranty & Repairs

  • Phones come with the standard Apple warranty (if new).

  • Repairs during the repayment period remain the customer’s responsibility unless covered by warranty.

8. Customer Responsibilities

  • Keep your M-Pesa account active to ensure timely payments.

  • Do not tamper with or attempt to remove Simu Pay software until full payment is made.

  • Provide accurate information during registration.

9. Limitation of Liability

Simu Pay is not liable for:

  • Loss of data, apps, or content if the phone is locked due to missed payments.

  • Unauthorized use of your account due to negligence in keeping your credentials secure.

10. Termination

  • Simu Pay reserves the right to terminate your account if you breach these terms.

  • Outstanding balances must still be paid even if your account is terminated.

11. Changes to Terms

  • Simu Pay may update these Terms & Conditions at any time.

  • Updates will be posted on our website with a new “Last Updated” date.
